Kalshi now faces criminal charges in Arizona. The company was already dealing with around 20 civil lawsuitsbut now, court documents indicate that he is being charged with class 1 and class 2 misdemeanors for alleged illegal gambling and illegal “election betting.”

At the federal level, New York City-based Kalshi is legally vulnerable in a way that its competitor, Polymarket, is not because, while Polymarket operates from abroad, Kalshi has to submit to US regulation by the Commodity Futures Trading Commission (CFTC).
But CFTC Chairman Mike Selig has disagreed with Arizona’s allegations. He published on Tuesday that “The Arizona Attorney General today filed criminal charges against one of our registered exchanges related to prediction markets. This is a jurisdictional dispute and completely inappropriate as a criminal proceeding.”
He added that his agency is “watching this closely and evaluating its options.”
According to NPRAn unnamed spokesperson for Kalshi called the charges “seriously flawed” and “baseless.”
