New York Gov. Kathy Hochul has suspended incomplete state environmental permit applications for large data centers while officials develop new rules, according to an executive order signed Tuesday.
The pause applies to data centers capable of consuming at least 50 megawatts of energy, with exemptions for manufacturing, research, education and medical facilities.
The rules development process is expected to take up to a year. New York becomes the first state to enact such a moratorium amid concerns about the impact of AI data centers on utility rates and public health.
The moratorium does not exclude all AI infrastructure. Data centers below the 50 MW threshold are not affected, and 50 megawatts is still enough power for approximately 20,000 to 30,000 modern GPUs.
What the New York executive order requires and why
The executive order directs multiple state agencies to develop new frameworks:
- The Department of Public Service (DPS) will develop a Generic Environmental Impact Statement (GEIS) that officials will use to evaluate the environmental, public health, and network impacts of proposed data center projects.
- Empire State Development, the state’s economic development agency, will develop a framework to help local communities negotiate benefits such as infrastructure improvements or financial support for community programs in exchange for hosting data centers.
- DPS will consider establishing a fund that data center operators could be required to pay into, including a potential insurance pool to protect taxpayers from stranded network costs tied to projects that are delayed, reduced or never materialize.
In addition to the moratorium, Hochul has promised legislation to end sales tax exemptions for data centers. Governor Hochul stated:
“New York has always been at the forefront of innovation and change, but we have also always ensured that New Yorkers benefit. As data center development threatens to increase utility bills, deplete our natural resources, and create uncertainty for New Yorkers, it is my responsibility to step up and lead.”
Several specific concerns are driving the pause:
- Rising utility bills for residents in states with large data center construction
- Air quality impacts due to portable generators used during grid connection wait times
- Environmental concerns, including water use and impact on land.
- Network stability issues due to concentrated additions of large loads
- Community impacts, including noise and strain on infrastructure.
Elon Musk’s Colossus 2 data center is currently facing legal challenges for alleged violations of the Clean Air Act related to the use of portable generators. That case has raised the profile of the generator air quality issue in the context of AI data centers.
Federal context, past and precedent state efforts
US President Donald Trump has separately expressed concern that AI infrastructure will increase costs for voters. In January 2026, the president demanded that Big Tech take responsibility for the energy their data centers consume. Several US states have launched investigations into why ratepayers are paying more despite claims that data centers would not affect residential utility bills.
The combination of federal pressure, state-level actions, and legal challenges indicates that data center regulation is likely to expand to multiple jurisdictions in the coming years.
Maine became the first state to pass a statewide moratorium on new data centers earlier this year, but the measure was vetoed by Gov. Janet Mills. New York’s approach, which uses executive authority rather than legislative action, avoids the veto risk that ended Maine’s effort.
New York’s moratorium can serve as a model for other states considering similar restrictions. States with major data center development proposals are likely to watch how New York’s rules develop and consider whether similar frameworks would work in their jurisdictions.
Possible solutions, impact on AI users and what comes next
The 50 MW threshold may not completely stop developers from moving forward. Remaining options include building multiple smaller data centers below the 50 MW cap, distributing workloads between sites in different states, or using high-speed, low-latency interconnects such as Nvidia’s Spectrum-XGS switches to connect physically separated smaller data centers into logical units capable of handling larger workloads.
Frontier model training typically requires substantial, centralized infrastructure that is difficult to divide across locations. However, inference workloads, which deliver trained models to users, can work effectively in smaller, distributed installations.
For AI users, the immediate impact is minimal. Current services continue to operate normally. Over time, if similar restrictions spread to other states, capacity limitations could influence the pace of launch of new AI services in the US, affect prices for AI services (especially those that rely on access to border models), and increase latency for services concentrated in specific regions. Additionally, the location of new capacity could shift toward states with more permissive rules.
For developers planning infrastructure in New York, practical considerations include checking the permit status of any planned data centers above 50 MW, exploring whether the project design can avoid the threshold, monitoring DPS and Empire State Development for updates on new rules, preparing for potential requirements to contribute to insurance or benefit funds, and staying alert to federal developments that could affect data center policies across the country.
The moratorium is expected to last up to a year while DPS develops the environmental impact framework. During this period, existing operations will not be affected.
Projects that received permits before the pause can move forward. However, new applications for installations of 50MW or more are pending the new rules.
Empire State Development will work with local communities to establish benefit frameworks.
